These Terms and Conditions govern your access to and use of the Montana Spirit Guest Lodge website and services.

By accessing our website, submitting an inquiry, making a reservation, or purchasing lodging, event, or related services, you agree to these Terms and Conditions. If you do not agree with these terms, please discontinue use of the website.

1. Website Purpose

The Montana Spirit Guest Lodge website provides information concerning accommodations, lodge amenities, fishing-related experiences, special events, retreats, recreational opportunities, reservation availability, and related services. Website information is provided for general informational and reservation purposes.

2. Eligibility

Individuals making reservations must have the legal capacity to enter into a binding agreement. The individual making a reservation represents that information submitted during the reservation process is complete and accurate and that he or she is authorized to make the reservation on behalf of all guests included in the booking.

3. Reservations

Submitting a reservation request does not necessarily guarantee availability. A reservation becomes confirmed only after Montana Spirit Guest Lodge provides confirmation and any required deposit or payment has been successfully received. Availability may change until the reservation has been confirmed.

4. Rates

Rates displayed on the website may vary based on accommodation selected, travel dates, occupancy, length of stay, seasonal availability, special events, packages, additional services, and applicable taxes and fees.

We reserve the right to correct pricing or typographical errors before confirming a reservation. Once a reservation is confirmed, the rate stated in the applicable confirmation generally governs that reservation unless otherwise required by law.

5. Deposits and Payment

Certain reservations, packages, retreats, or special events may require an advance deposit. The amount of the deposit, balance-due date, and payment schedule applicable to a reservation will be provided during booking or in the guest’s reservation confirmation. Failure to make a required payment by the specified deadline may result in cancellation of the reservation.

6. Special Events and Packages

Special-event reservations may have separate deposit requirements, minimum stays, maximum stays, arrival dates, departure dates, occupancy requirements, payment schedules, cancellation terms, and refund terms.

When special-event or package terms differ from these general Terms and Conditions, the specific terms displayed during booking or provided in the reservation confirmation will control.

7. Guest Information

Guests are responsible for providing accurate contact, occupancy, and reservation information. Guests must notify Montana Spirit Guest Lodge if the number of occupants or other material booking details change. Additional occupants may be subject to availability, occupancy restrictions, and additional charges.

8. Check-In and Check-Out

Applicable check-in and check-out times will be communicated with the reservation or prior to arrival. Early arrivals or late departures are subject to availability and must be approved by Montana Spirit Guest Lodge. Additional charges may apply where appropriate.

9. Property Use

Guests must use accommodations, property, furnishings, recreational areas, river-access areas, equipment, and amenities responsibly. Guests may not engage in conduct that damages the property, creates an unreasonable disturbance, endangers another person, violates applicable law, violates posted property rules, or interferes with another guest’s enjoyment of the property.

10. Damage and Additional Charges

The booking guest may be responsible for damage, excessive cleaning, missing property, unauthorized occupancy, or other losses caused by the guest or members of the guest’s party. Where permitted by law, reasonable charges associated with such damage or loss may be assessed after the stay.

11. Outdoor and Recreational Activities

Montana recreation may involve natural and environmental risks, including changing weather, wildlife, uneven surfaces, rivers, water conditions, fishing activities, remote terrain, insects, vegetation, slippery surfaces, and other conditions associated with outdoor environments. Guests should exercise reasonable care and make decisions appropriate to their abilities and conditions.

12. Fishing Activities

Fishing availability and conditions may vary depending on weather, water conditions, government regulations, seasonal restrictions, wildlife conditions, access restrictions, and other circumstances outside Montana Spirit Guest Lodge’s control.

Guests are responsible for obtaining any fishing license or permit required by applicable law unless expressly stated otherwise in a package. Nothing on the website guarantees fishing success, particular river conditions, or availability of any specific species.

13. Third-Party Activities

Certain services, excursions, equipment rentals, guides, transportation services, or recreational experiences may be provided by independent third parties. Unless otherwise stated, such providers are independent businesses and are responsible for their own services. Montana Spirit Guest Lodge is not responsible for acts or omissions of independent third-party providers except as required by applicable law.

14. Weather and Natural Conditions

Weather, river conditions, wildfire, smoke, road conditions, wildlife activity, power outages, government restrictions, or other natural events may affect travel or recreational activities. Montana Spirit Guest Lodge cannot guarantee particular weather, fishing, river, road, or environmental conditions.

15. Website Accuracy

We make reasonable efforts to keep website information accurate and current. However, photographs, descriptions, availability, amenities, events, pricing, and other information may change. Photographs are intended to represent the property but may not reflect every current furnishing, feature, seasonal condition, or surrounding environment.

16. Intellectual Property

Website text, graphics, photographs, logos, designs, videos, layouts, branding, and other original content are owned by or licensed to Montana Spirit Guest Lodge unless otherwise indicated. Content may not be copied, reproduced, republished, distributed, modified, or commercially exploited without prior authorization, except as permitted by law.

17. Prohibited Website Activities

Users may not attempt unauthorized access to the website or server, interfere with website security, introduce malicious software, scrape or harvest information through unauthorized automated means, impersonate another person, submit fraudulent information, or use the website for illegal purposes.

18. Disclaimer of Warranties

To the extent permitted by law, the website is provided on an “as available” basis. We do not guarantee that the website will always operate without interruption, errors, delays, security vulnerabilities, or technical problems. Nothing in these Terms excludes warranties or protections that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Montana Spirit Guest Lodge will not be liable for indirect, incidental, special, punitive, or consequential damages resulting solely from use of or inability to use the website. Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.

20. Indemnification

To the extent permitted by law, users agree to be responsible for losses, claims, damages, or expenses arising from their unlawful use of the website, intentional misconduct, violation of these Terms, or damage caused by themselves or members of their party.

21. Governing Law

These Terms and Conditions shall be governed by applicable federal law and the laws of the State of Montana, without regard to conflict-of-law principles. Any dispute shall be subject to the jurisdiction of an appropriate court in Montana unless otherwise required by applicable law.

22. Changes to These Terms

Montana Spirit Guest Lodge may revise these Terms and Conditions periodically. The version posted on the website at the time of use will apply to website use, while reservation-specific terms applicable when a booking is confirmed will continue to govern that reservation unless otherwise required by law.

23. Contact
